2. Ritherch ap Jevan of Istradvelty, yeoman
LEASE (counterpart) for 21 years of a tmt and lands called Tir pant y Llwyn in Istradvelty.

 

This indenture made the first day of September in the twelveth year of the Reigne of our Soveraigne Lord Charles by the grace

of God Kinge of England Scotland Frannce and Ireland Defender of the faith & Between William Morgan of Therrowe in the County of Brecon[shire]

Esq[uire] of the one p[ar]te And Ritherch ap Jevan of the P[ar]ish of Ystradvelty in the said county of Brecon[shire] yeoman of the other p[ar]te Witnesseth that the said

William Morgan for diverse good causes and valuable considerations him thereunto especially moveinge hath demised granted and to farme letten And

by these p[re]sents doth demise grant and to farm lett and sett unto the said Ritherch ap Jevan All that one tenement of lands w[i]th the appurteninces

commonly called or knowne by the name of Tir Pant y Llwyn scituate lyeinge and beinge in the said p[ar]ish of Ystradvelty in the said County of Brecon[shire].

Together w[i]th all waters wayes Commons meadows leasowes pastures woods under woods wastes wayes easementes profitts commodities emoluments and advantages whatsoever

unto the said tenement or p[re]misses incident belongeing or in anniewise app[er]tayneinge accepted reputed knowe or taken as p[ar]te p[ar]cell or member therof To Have and to Hold

the said tenement of lands w[i]th the appurtan[en]ces and all and singular other the aforesaid p[re]misses hererby demised granted and to farme letten or intended to be demised granted and to

farm letten unto the said Ritherch ap Jevan his executors administrators and assigns from the feast day of St Michaell Th[e ]archangell next ensueinge the date of these pr[es]cents

for and during and unto the full ende and forme of one and twenty years from theure next ensueinge and fully to be completed and ended yeildinge and paying therefore

yearly during the said term unto the said William Morgan his heirs or assigns the Sume of fouer pounds and tenne Shillings of Lawfull mon[e]y of England at twoe the most of

feasts in the year That is to say the Feast of Th[e ]annunciation of o[ur] blessed Lady St Mary the Virgin and St Michael Th[e ]archangell by even and equal portions And all for yeildinge

and paying therefour yearly unto the said William Morgan his heirs and assigns one couple of fatt crammed caypons and a fatt goose on every feast day of the Circumsision of o[ur]

Lord God three horse loads of Cole at Midsommer yearly And a herriott of the best beast uppon the decease of every tenant dyinge in possession of the p[re]misses or of any p[ar]te thereof

And if it happen that the said yearly rent or duties or any of them to be behind and unpayed in p[ar]te or in the wholl by the space of fifteen days next after any of the said feast days

or tim[es] wherein the Land ought to have beene payed or demm[ised] and the farm[er]being lawfully demanded That Thou it shall and may be lawful to and for the said William Morgan

his heirs and assignes into the p[remis]es to reenter and the same to have againe repossess and injoy as in his or their former estate, any things herein contayned to the contrary in

anywise notwithstanding provided always and if it is conditioned agreed by and between the said p[arpties That the said Ritherch ap Jevan his executo[rs] nor administrato[rs] nor

any of them shall not during the said terme alyen lett sett demise or assigne the said tenement of lands and pr[em]misses or any p[ar]te or p[ar]tes thereof unto any p[er]son or p[er]sons whatsoever

w[i]thout the speciall licence of the said William Morgan his heirs or assignes in writeinge in that behalf first had and obtayned provided likerwise and it is conditioned and agreed

by and between the said p[ar]ties that the said Ritherch ap Jevan his heirs nor assigns nor any of them shall not during the said terme for w[i]th the p[re]misses are demised destroy

fall cut downe or fell away any of the timber trees woods or underwoods nowe groweinge or standing in or upon the p[re]misses or any p[ar]te thereof, or w[i]th shall or may hereafter

growe in or upon the p[re]misses during the said term And the said Ritherch ap Jevan doth for himself his executors Administrators and assigns and for every of them co[n]cent

promise grant and agree to and with the said William Morgan his his heirs executors administrators and assigns and to and w[i]th every one of them by these p[re]sente That hee the said

Ritherch ap Jevan his executors Administrators and assigns and every of them shall and will from time to time for and during the terme aforesaid for w[i]th the pr[e]misses and demised

at his and their owne costes and charges will and sufficiently repayer amend sustayne mayntayne and keep the houses or thereofes & diffires buildings and fences thereunto X X X X

belonging [in good and sufficient reparationes] And that the said Ritherch ap jevan his executors administrators and assigns shall and will from time to time during the said terme sufficiently maintaine

and make sufficient hedges fences and ditches in and about the pr[e]misses in a tenanntable mannor and the same soe repayred amended shall at the ende and exipiration of

the said term of one and twenty years lease and yield xxxs unto the said William Morgan his heirs & assigns In Witness whereof the p[ar]ties abovesaid to these

[e]xeseutes hand Enter honnorably sett to their hands and seales the day and yeare first above written 1636
