LEASE for 21 years of the m. and lands called Pant y Llwyn in Ystradvelltey, also a sixth part of the tithes of corn, grain, and hay in Ystradvelltey, but reserving timber and minerals.

 

THIS INDENDITURE made the eighth day of January in the sixteenth year of the reign of our Sovereign Lord George the Third by the Grace of God of Great Britain France and// Ireland King Defender of the Faith and so forth and in the year of our Lord One thousand seven hundred and seventy six

 

BETWEEN the Honourable Charles Morgan of Tredegar in the County of Monmouth Esquire of the one part and Thomas Jones of// the Parish of Ystradvelltey in the County of Brecon Gentleman of the other part

 

WITNESSETH that the said Charles Morgan for and in consideration of the yearly Rents Covenants Provisions and Agreements herein after specified and reserved on the// part and behalf of the said Thomas Jones his Executors and Administrators to be paid done fulfilled performed and kept HATH Demised leased granted Let and to Farm let and by these presents DOTH Demise Lease Grant let and to Farm Let unto the// said Thomas Jones ALL that Messuage Tenement and Lands with the appurtenances commonly called and known by the name of Panty Llwyn situate lying and being in the said Parish of Ystradvelltey in the County of Brecon aforesaid and now in the Tenure and occupation of the said Thomas Jones Together also with the all that the sixth Part or Share of all those the Tenth or Tithes of all manner of Corn Grain and Hay yearly Growing increasing or arising within the said Parish of Ystradvelltey and all other// Tithes those wherein the said Charles Morgan now hath or ought to have any Right Tithes property or Claims in as large ample beneficial manner as the said Thomas Jones heretofore did and now doth hold and enjoy the said Messuage Tenement Lands and Tenths// or Tithes

 

EXCEPT and always reserving out of this present Demise all Timber Trees and Growth likely to become Timber Trees and all other Wood and Underwood now standing growing or being or which shall or may stand grow or be at any time hereafter in or upon// the said Demised Tenement and Lands called Pant y llwyn or any part or parcel thereof and also all Works or Veins of Tin Lead Copper and Iron Ore, Coal and Culm and all Quarries of Stone and Slate and all other mineral productions whatsoever now// lying and being on that shall or may at any time hereafter be or be open or found Covert or hid in upon or under the said Demised Tenement and Lands called Pant y llwyn or any part thereof with full and free liberty of Building and Erecting such Houses Cotts or// Hutts, Breaking Ground Sinking Shafts or Pits driving levels, drawing up landing Washing Dressing and doing all other necessary Work and Labour upon the said Tenement and Lands call panty llwyn or any part thereof to render any and every the said Tin// Lead, Copper, Iron Coal and Culm or other Minerals marketable and also with full and free power and liberty of Ingress, Egress and Regress to and for all the said Charles Morgan his Heirs and Assigns and his and their Agents, Servants and Workmen at all and every Season// and Seasons in the year into and upon and from any and every part of the said premises tenement and lands called pant y llwyn to come and go with Implements Horses Cattle Carts and any other Carriages whatsoever to Bark, Fell cut down Hew Square Saw Cord Coal and Chark the// said Timber Trees Wood and Underwood and to remove carry away and drive off the said Minerals Timber Wood Bark and Charcoal off and from the said Demised Premises as often as occasion shall require without the let hindrance molestation or Interruption of him// the said Thomas Jones his executors or Administrators and without making any Reparation amounts or Satisfaction for any Damage that may be Suggested to have been done thereby or to arise or happen from or by means thereof provided no wilful hurt or damage be thereby// Done to the Corn Grain Hay or Grass of the said Thomas Jones his Executors or Administrators growing or being upon the said Premises or any part thereof

 

TO HAVE AND TO HOLD all and Singular the said Demised Premises with their and every of their respective// appurtenances (except as before excepted) unto the said Thomas Jones his Executors and Administrators from the Twenty Ninth day of September last past for and during and unto the full End and Term of One and Twenty years Hence wood ensuing and fully to// be complete and ended

 

YIELDING AND PAYING yearly and every year during the said Term into the said Charles Morgan his Heirs or Assigns for the said Messuage or Tenement and Lands called Pant y Llwyn the yearly Rent or Sum of Four Pounds and fourteen// Shillings and for the said Part or Share of the Tenth or Tithes of the said Parish of Ystradvelltey the yearly Rent or Sum of Fifteen pounds both of good and lawful Money of Great Britain payable twice a year by even and equal portions (that is to say) for both the Sum of Nine pounds// and seventeen Shillings upon every the Twenty fifth Day of march and the like Sum of Nine Pounds and seventeen Shillings upon the Twenty ninth day of September yearly and every year during the said Term the first payment to commence and to become// payable upon the twenty fifth day of March next ensuing the date hereof Together with one fat Goose and a Couple of Fat Hens at Christmas yearly in lieu of custom or Three Shillings in lieu thereof free clear and exempt of and from all and all manner of Chiefrents// Quitrents Rates Taxes Charges Assessments or other Outgoings whatsoever which now and or hereafter shall be Rated taxed Charged Assessed or imposed upon the said Demised Premises or and part thereof or upon the said Charles Morgan his Heirs or Assigns for or in// Prospect thereof by Parliament or otherwise howsoever during the said term

 

AND the said Thomas Jones doth for himself his Executors and Administrators and for every of them covenant promise and agree to and with the said Charles Morgan his Heirs and Assigns// and to and with every of them by those present in manner and form following (that is to say) that the said Thomas Jones his Executors and Administrators or one of them shall and will yearly and every year during this Demise well and truly pay or cause to be paid// unto the said Charles Morgan his Heirs or Assigns the said yearly Rents or Sums of Four pounds and fourteen shillings and Fifteen pounds making in all Nineteen Pounds and fourteen shillings on the days and times as and in manner above limited// for the payment thereof without any deduction as aforesaid according to the true intent and meaning of the presents and shall and will pay bear and discharge all and all manner of Chiefrents Rates Taxes Charges and other outgoings whatsoever// which now are or hereafter shall be Rated Taxed Charged Assigned or Imposed upon the said Demised Premises or any part thereof or upon the said Charles Morgan his Heirs or Assigns for or in respect thereof by Parliament or otherwise howsoever during the said Term//

 

AND ALSO that he the said Thomas Jones his Executors or Administrators shall and will from time to time and at all times hereafter during the Continuance of this Demise at his and their own proper Costs and Charges well and sufficiently Repair mend maintain uphold// Support Cleanse Scour and keep the said Message or Tenement Outhouses and Buildings in and upon the said Demised Premises called Pant y llwyn and every part thereof as well within as without and the Walls Doors Roofs Gates Rails Stiles Hedges Ditches Watercourses Fences and Inclosures in upon and about the said Premises in good Substantial and Tenantable Order and Repair and at the Expiration or other sooner determination of the said Term shall and will peaceably and quietly leave Surrender Yield and deliver up the said// Messuage or Tenement Outhouses and Buildings Tenths and Tithes and all Singular other the said Demised Premises with their and every of their appurtenances unto the said Charles Morgan his Heirs or assigns in such good substantial and  Tenantable Order and// Repair in all Respects

 

AND ALSO shall and will yearly and every year during the said Term in Husband like manner Spend all the Straw Hay and Fodder that shall yearly increase grant and be in or upon that part of the said Demised Premises// called Pant y llwyn and all the Dung Soil and Compost thereof made shall and will lay and Bestow Or leave to be laid and Bestowed in or upon the said Demised Premises called Pant y llwyn or some part thereof and not elsewhere nor otherwise// than in a husband like manner

 

AND ALSO that it shall and may be lawful to and for the said Charles Morgan his Heirs and Assigns and his and their Agents Servants and Workmen at all times during the said Term at his and their respective// Will and pleasure to enter into and come upon the said Demised Premises and every part thereof to View Search and See into the State and Condition of the said Premises and the Repairs Amendments or defects thereof and also to search and see if// any Waste Spoil or Destruction be committed done or permitted in or upon the said Demised Premises or any part thereof during the said Term and of all such defects and want of Repairs which upon such View or Views shall be then and there found to give// or leave notice in Writing to and for the said Thomas Jones his Executors or Administrators to his or their Dwelling house on the said Demised Premises to Repair and amend the same within the space of three Calendar Months next after such notice// shall be given or left as aforesaid within which said space of Three Calendar Months the said Thomas Jones his Executors or Administrators shall and will and Substantially Repair and Amend the same accordingly or in default thereof that is shall and may be// lawful to and for the said Charles Morgan his Heirs or Assigns or their Agent or Agents to Employ Workmen find Materials and otherwise well and sufficiently to Repair and Amend the same and that he the said Thomas Jones his Executors or Administrators shall and// will repay and reimburse to the said Charles Morgan his Heirs or Assigns or his or their Agent or Agents all such Sum and Sums of Money as they or any or either of them shall lay out and Expend for the purpose aforesaid at or upon the Rent Day which shall// next happen after such Repairs and Amendments shall be so done and performed

 

AND FURTHER also that he the said Thomas Jones his Executors or Administrators shall not and will not Fell Cut Down Root up Lop Top Crop or Shred any Timber// Trees or Trees likely to become Timber not Cut down any Wood or Underwood nor cause procure or permit the same to be done by any other but what shall be absolutely necessary for Hedgeboot Ploughboot and Fireboot in such manner as the same// shall be set out and allotted by the said Charles Morgan his Heirs or Assigns or his or their Agent or Agents if it be had or found upon the said Demised Premises but nowhere else to be procured or Sought for, and to be used and spent upon the said// Demised Premises and not elsewhere or otherwise and shall not and will not do or commit or Wittingly suffer to be done or committed any manner of Waste Spoil or destruction whatsoever upon the said Demised Premises or any// part thereof but in a good and Husband like manner shall and will manage and occupy the same in all respects during the said Term, And shall not and will not Plough up or Convert into Tillage nor cause or procure to be Ploughed// up or converted into Tillage any piece or parcel of meadow Ground being part of the Premises aforesaid Or shall Sell Alien Assign Transfer or set over this Indenture of Lease or the Term hereby Granted or any part thereof or the Lands// and Promises Tenths or Tithes hereby Demised or any part of the same without the License or consent of the said Charles Morgan his Heirs or Assigns under his their or either of their Hands and Seals first had and obtained in writing

 

PROVIDED// always nevertheless and it is hereby Covenanted Conditioned Concluded and agreed upon by and between the said Parties to these presents and it is their true intent and meaning and the true intent and meaning of these// presents and it is hereby declared to be That if the said Yearly Rent of Nineteen Pounds and Fourteen Shillings or any part thereof shall be behind and unpaid for the space of Fifteen Days next over or after the Days or Times whereon// the same ought to be paid as aforesaid and no sufficient Distress or Distresses to be had or found on the said Premises for satisfaction thereof or if the said Thomas Jones his Executors or Administrators shall Assign Transfer, Alien or Demise// this Indenture of Lease or the Promises hereby granted or any part thereof to any Person or Persons whatsoever without the Licence and Consent of the said Charles Morgan his Heirs or Assigns under his and their Hands and Seals first had and obtained in// Writing for that purpose or shall commit or Suffer any Waste Spoil or Destruction upon the said Premises or suffer the same or any part thereof to fall into decay or make any breach or non-performance of all or any of the Covenants herein before mentioned That// then in all either or any of the said cases these Presents and every Clause Article and Covenant herein contained shall cease determine and be utterly void and thereupon it shall and may be lawful to and for the said Charles Morgan his Heirs and Assigns or any other Person or// Persons by him or them lawfully authorized in his their or either of their Name or Names into and upon the said Demised Premises or any part thereof in the name of the whole to Re-enter and the same and every part thereof to have again Repossess and enjoy as in his// or their former Estate anything herein before contained to the contrary in anywise notwithstanding

 

AND LASTLY that it shall and may be lawful to and for the said Thomas Jones his Executors and Administrators at and under payment and performance of the Rents// Covenants Clauses Provisions and Agreements herein before contained peaceably and quietly to have hold Use Occupy Possess and Enjoy all and Singular the said Demised Premises with their respective Appurtenances (Except as before Excepted) for and during the Term// hereby Granted without the lawful let Suit Trouble Molestation or Disturbance of him the said Charles Morgan his Heirs or Assigns or any other Person or Persons whatsoever Claiming or to Claim by from or under him them or any of them IN// WITNESS whereof the said Parties to these presents have hereto interchangeably set their Hands and Seals the Day and Year first above Written.
